MANICK HILLSIDE / BUYER GUIDE
Can a foreigner own a villa in Phuket? Yes. Foreign buyers can own the villa building separately from the land, with land-use rights secured through a registered 30-year lease. Explore freehold and leasehold ownership, resale, inheritance, purchase costs and the buying process at Manick Hillside.
01 / OWNERSHIP EXPLAINED
Manick Hillside can accommodate different ownership arrangements depending on the buyer's legal eligibility and the villa concerned. Thai individuals may purchase eligible land and villas freehold; foreign individuals commonly use registered land leasehold with separate villa ownership; and qualifying Thai companies may acquire land and buildings where permitted by law. Each option requires appropriate legal review and registration.
Eligible Thai nationals may purchase the land and villa outright in freehold, subject to title verification and the applicable sale and Land Office registration documents. This is distinct from the land-lease structure typically offered to foreign individual buyers.
For foreign individual purchasers, Manick Hillside offers an initial registered 30-year land lease with separate ownership of the villa building. A standard renewal memorandum provides contractual arrangements for two additional 30-year terms, subject to the signed documents, Thai law and future registration. The renewal consideration is included in the original purchase arrangement; the lessee pays applicable renewal registration fees and taxes.
A legally qualifying Thai company may be able to purchase the land and villa freehold. Eligibility depends on the company's genuine shareholding, control, business circumstances and applicable Thai land and corporate law. Thai nominee shareholders used to circumvent foreign ownership restrictions are not a lawful ownership solution. Buyers should obtain independent Thai legal advice before selecting this route.
Under Manick Hillside's foreign-buyer sale and lease documentation, the developer undertakes to convey ownership of the villa building separately from the registered lease of the land after the agreed payments are completed. Ownership and registration arrangements differ for Thai freehold purchases and qualifying company acquisitions, and must be confirmed in each transaction.
The information on this page describes Manick Hillside's developer documentation and current commercial offering. It is not legal advice. Renewal rights are contractual commitments, not a 90-year lease registered in advance; future renewals remain subject to their terms and applicable law. All details should be confirmed against the current signed agreements.
02 / YOUR PURCHASE JOURNEY
Our developer agreements set out the stages of purchase, construction, inspection, payment and registration. Completed residences, resales and Phase II construction purchases can follow different schedules, so the current villa-specific documents should always be reviewed.
Explore Phase I residences and Phase II opportunities. We can arrange a private viewing and discuss the villa, plot, specifications and ownership preferences.
Request the current price, inclusions, availability, proposed ownership structure, floor plans and a breakdown of applicable fees.
At Manick Hillside, we welcome and actively recommend independent due diligence. Buyers are encouraged to appoint their own Thai property lawyer to review the land title, ownership structure, permits and purchase agreements. We are happy to provide the relevant developer documentation and cooperate with the review, giving buyers confidence and peace of mind before proceeding.
A 2% reservation deposit secures the villa. Within 30 days, we work with the buyer to finalise contracts, legal documentation and agreed villa plans. The second payment of 33% is then due to commence construction. Further instalments follow verified construction milestones, with the final 5% payable upon transfer and registration at the Land Office. This is our standard off-plan schedule; terms can be tailored by agreement.
Following completion of the villa, and once the agreed purchase payments and documentation are finalised, our team coordinates the ownership transfer and relevant registrations at the Land Office. Depending on the buyer's chosen and legally eligible ownership structure, this may involve freehold transfer of the land and villa or registration of a land lease alongside separate villa ownership. We guide buyers through the required documentation and transfer process.
Before handover, buyers are invited to inspect their completed villa with our team and identify any outstanding items for attention. We work through the agreed handover checklist, explain the home's key systems and provide the relevant warranty and aftercare information. Our commitment to our owners continues beyond the day they receive their keys.
03 / COSTS & CONSIDERATIONS
The total cost of buying and holding a villa depends on whether the transaction is a developer sale or resale, registered values, contract terms and selected services.
For a standard developer sale, the specified initial ownership-transfer and registration costs are generally shared equally between buyer and developer, as agreed in the purchase documents. For lease renewals, the lessee pays applicable registration fees and taxes. Resale costs and any villa-specific arrangements are confirmed in writing before purchase.
Ask for a written breakdown of estate or common-area charges, utilities, pool and garden maintenance, insurance and any optional management or rental services.
For Phase II off-plan purchases, the agreed villa specifications, final plans and construction milestones form part of the buyer's purchase documentation. Our standard payment schedule follows construction progress, with opportunities to discuss individual requirements and customisation before plans and contracts are finalised. Any changes are agreed and documented with the buyer.
Manick Hillside is first and foremost a private residential community, where homeowners value privacy, tranquillity and a peaceful living environment. Owners may enjoy their villa as a personal residence or consider longer-term rentals that respect the character of the estate and applicable regulations.
04 / FREQUENTLY ASKED QUESTIONS
Yes. Foreign buyers can own a villa building in Phuket separately from the land beneath it. At Manick Hillside, the foreign-buyer structure combines separate villa ownership with a registered 30-year land lease. Foreign individuals generally cannot own Thai land freehold. Eligible Thai nationals may purchase land and villas freehold, while legally qualifying Thai companies may also be eligible, subject to Thai law and independent legal review.
No. A registered land lease grants contractual rights to use the land for its registered term; it does not transfer ownership of the land. Eligible Thai purchasers can instead acquire freehold title. Foreign buyers should review the lease, renewal memorandum and separate building ownership documents with an independent Thai lawyer.
At Manick Hillside, foreign buyers can secure a registered 30-year land lease, together with separate ownership of their villa. Under Thai law, the initial land lease is registered at the Land Office for a maximum period of 30 years. To support longer-term ownership planning, Manick Hillside also provides a separate renewal memorandum setting out contractual commitments concerning two additional 30-year lease terms. Each future renewal is subject to the signed agreements, applicable Thai law and registration requirements at that time. We encourage buyers to review these documents with their independent Thai legal adviser.
Yes. Owners are free to resell their villas. For foreign leasehold owners, the sale involves transferring ownership of the villa building and arranging the incoming buyer's land-lease rights in accordance with the relevant agreements and Land Office requirements. Our team can assist with the documentation and transfer process.
Yes. At Manick Hillside, a resale can be structured with a new registered 30-year land lease for the incoming buyer, rather than simply transferring the remaining term of the existing lease. This is arranged with the landowner and documented and registered at the Land Office in accordance with Thai law. Our team will explain the process and applicable transfer costs for the villa concerned.
Yes. Villa owners can pass ownership of their villa to their children or other beneficiaries through their estate. Manick Hillside's Land Lease Agreement expressly provides for succession, with its terms binding on successors, assignees, heirs and executors. As ownership of the villa and the land lease are separate legal interests, inheritance and any necessary transfer or registration must be handled in accordance with the agreement and applicable Thai law. We recommend that owners make appropriate estate-planning arrangements with a Thai lawyer.
Ask an independent Thai property lawyer to verify the land title, encumbrances, access, building permits, transfer documentation and ownership eligibility. For foreign leasehold buyers, review the land lease, renewal memorandum and building transfer. For company purchasers, also verify genuine Thai ownership, control, compliance and ongoing corporate obligations.
Phase II payments are linked to agreed construction milestones, so instalments follow the progress of each villa. Our standard off-plan schedule is 2% to reserve the villa, followed by 33% upon signing the final contracts (typically within 30 days). Four further payments of 15% are due at the agreed stages of foundation posts, concrete structure, walls and door frames, and flooring, painting, windows and doors. The final 5% is payable after villa completion, at ownership transfer and registration at the Land Office. This is our standard framework, not a fixed requirement: payment terms can be tailored by agreement to suit both the buyer and seller, with the final schedule clearly documented in the purchase contract.
Request the latest written schedule of common-area fees, maintenance, utilities, insurance and any management charges. Amounts vary by villa and services.
Prospective buyers can request available ownership and transaction information for review with their independent lawyer. Document availability and terms should be confirmed with our team.
Ownership options, payment schedules, transfer costs and warranty terms depend on the villa, the buyer's eligibility and the final signed agreements. This buyer guide describes Manick Hillside's standard approach and is provided for general information; purchasers are encouraged to seek independent Thai legal advice.
